These terms are the agreement between you and 1505778 B.C. LTD. (“HereNook”, “we”) for using herenook.com, HereNook Studio at app.herenook.com, and Nooks on gonook.io. Please read them before you create an account. If you don’t agree, please don’t use HereNook.
The short version
You own what you put on your Nook. You give us permission to host and show it.
Keep it legal and honest: no impersonation, scams, hate, or other people’s work without permission.
Paid plans renew until you cancel. You can cancel any time in Studio.
Connected services like Instagram, Facebook, Google and Stripe have their own terms too.
How we handle personal information is in our Privacy policy.
Using HereNook
You must be at least 18 years old, and old enough to make a binding agreement where you live. If you use HereNook for a business, you confirm you are allowed to act for it, and these terms apply to that business too.
Keep your sign-in secure. You are responsible for what happens in your account and workspace, including what people you invite do there. Tell us straight away if you think someone else got in.
Your content
Your words, photos, videos, audio, logos and links stay yours. To run HereNook, you give us a worldwide, non-exclusive, royalty-free permission to store, copy, resize, convert and show that content on your Nooks, in Studio, in previews and share cards, and in QR codes and downloads you create. This permission ends when you delete the content or your account, except for copies we must keep for a short time in backups or by law.
Only upload content you have the right to use. Your Nooks are public: anyone with the link or QR code can see them.
Stock photos you add from Pexels or Pixabay are covered by those services’ own licences.
Fair use rules
Please don’t use HereNook to:
break the law, or help anyone else break it;
pretend to be a person or business you are not, or mislead people about who you are;
run scams, phishing, malware, or links that hide where they go;
post hateful, harassing, violent, sexually explicit or exploitative content, or anything involving the sexual exploitation of children;
use someone else’s photos, trademarks or other work without permission;
send spam, or collect other people’s information without their agreement;
overload, probe, scrape or get around the limits or security of HereNook.
We may remove content, pause a Nook or QR destination, or close an account that breaks these rules. Where it is safe and lawful, we will tell you why and give you a chance to fix it. To report a Nook, contact us.
Names and addresses
Nook addresses and chosen names follow our naming policy. A name gives you an address to share; it is not proof of identity or a trademark right.
Sample Nooks we build
Sometimes HereNook builds a sample Nook for a real local business from information it has made public, such as its Google listing, website or social profiles. A sample stays clearly ours until the business claims it. When the owner claims it, the Nook and its content move into the owner’s workspace and these terms apply to them.
If you own a business we built a sample for and want it taken down, contact us and we will remove it.
Plans and payments
Free stays free. Paid plans (The Essentials and The All In) are billed in advance, monthly or yearly, through Stripe. Stripe’s terms also apply to payments.
Paid plans renew automatically at the end of each billing period until you cancel. You can cancel any time in Studio; your plan stays active until the end of the period you have paid for.
Prices shown include or exclude tax as shown at checkout. If we change a price, we will tell you before it applies to your next renewal.
Refunds: We don’t refund part-used periods, except where the law requires it.
When paid access ends, features beyond Free stop working, as described on the plans page and in the naming policy. Your content is not deleted just because a plan ends.
Connected services
Some features use other services you choose to connect or show, such as Google sign-in, Google reviews, Instagram, Facebook, Pexels and Pixabay. Your use of those services is under their own terms, and they may change or stop what they offer. If that happens, the matching HereNook feature may change or stop too.
Instagram and Facebook connections are read-only. You can disconnect them any time; see Delete your data.
Changes and availability
We are always improving HereNook, so features change. We work hard to keep Nooks and QR codes online, but we can’t promise HereNook will always be available or free of errors. Please keep your own copies of anything important.
Ending
You can stop using HereNook and ask us to delete your account at any time; see Delete your data. We may close an account that seriously or repeatedly breaks these terms, or if the law requires it. Printed QR codes that point to a closed account will stop leading to your content.
Warranties and liability
HereNook is provided “as is”. To the extent the law allows, we make no promises beyond those in these terms, and we are not liable for indirect or consequential losses, such as lost profits, lost data or lost business. Our total liability for any claim about HereNook is limited to the greater of the amount you paid us in the 12 months before the claim and 100 Canadian dollars.
Nothing in these terms takes away rights you have under consumer protection laws that can’t be waived.
Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. If we have a disagreement, please contact us first so we can try to sort it out.
Changes to these terms
If we make important changes, we will post the new terms here and tell account holders by email or in Studio before they take effect. If you keep using HereNook after that, the new terms apply.
